"Offensive" content regarding the EULA?

I got the email about the updated legal stuff in the EULA and had a quick read through.
One thing that bothers me is this paragraph here. I'm not entirely sure how to interpret it.

Do not do or say anything which is or may be considered threatening, abusive, obscene, racist, xenophobic, sexist, defamatory, pornographic, sexually explicit or otherwise offensive or illegal. This includes masked words (---), acronyms and abbreviations.
This is section 6.(viii) of the User Agreement seen here:

So I'm obviously not going to blast racial epithets and the like at people on the forums or YYG staff.

What I am wondering about is how this affects games made with YYG products?

Are parodies that some might consider black humour or dark satire cause for getting a licence revoked?

What about if I have a game with a villain, and the villain in his villainy says some despicable things, and this upsets someone? Content that is in no way meant to represent the views or opinions of a sane and rational person I mean. Would that count as breaching the EULA?

I believe if im reading correctly
Thats just for like the forms, community, and marketplace, your game should be fine to express racism or sexism as free speech or satire

If not that conflicts with real laws at least in America
Such as free speech and fair use

I'd take that as being GMS itself, being part of the EULA.

I guess YYG just don't wan't to be associated with that kind of thing. Just covering themselves in case something got really ugly, which is fair enough.

A game not having anything in it deemed 'illegal' is kind of interesting though. There goes all FPS and most platform games then.

Hotline Miami is on the YoYoGames website showcase. That should give you a general idea of what is allowed. Basically that's just legalese for "don't make us look bad."
Yeah that's a good point, I didn't consider that. Kinda crazy how this fear of deplatforming and mob justice has gotten to this point though.

This clause is a "just in case" clause and usually is only used in extreme cases. It's basically a way for any company to wash their hands of liability for anything offensive and permit them to pull the plug on the product. For this to happen though, you'd need to create something SERIOUSLY offensive and probably also need some kind of legal repercussion like have been reported to the police for hate crimes or something. I'm pretty sure every EULA for every product that permits user-generated content contains such a clause and I wouldn't worry too much about it. GM has always had a clause like that in it's legal terms and I don't think it's ever actually been used...

This is definitely true, and not only that theres more... This also happens with users posting free content for indie games on websites. Along the years they have built an image for themselfs between them and the audience... And by using their name and image on your game, you are actually damaging their name and reputation, and promoting your game with the name they have built for themselfs...

This is a mistake ive made it to often, and i was doing it with the best intentions has a way of saying thank you to that person for giving me that free content... This only result in backfiring agaisnt me, people getting angry at me, people saying my game was made by the developer(S), me / mr whatever / another mr whatever / and another guy somewere... When the content was only made by me... I should've kept my mount shut, and posted only my name on the credits... If other people wanted their name in there they wouldve come to me and they you ve told me. Has a result their name on the credits only resulted in offending and violating lots of sensibilities.


I think yoyo games will want GM name on anything that looks innovating, anything else that looks to crappy can damage their reputation... Anyway i believe they will contact the user if they are intrested in seeing GM name on that game.

[EDIT] I mean how many times have we seen a game were there is a giant dic* running around jump from platform to platform, now theres big letters saying made in game maker, obviously its not going to look good.

If I correctly remember, a similar clause appeared in versions dating back to when Mark Overmars owned GM. It’s not new (by over a decade), and nothing to worry about...

Which means someone needs to start writing articles, books, producing videos and holding lectures about how GM users and under threat, and how we're speeding towards a future without free speech. They need to find young people without media training. When the young people bashfully attempt to argue the clause isn't noteworthy, it's important to embarrass them with an aggressive charismatic performance. Later clipped content exposing them as "savagely destroyed" will rake in views (especially if you toss in some stock footage from unrelated protests). Digitally astroturf that comments section, and make bank. :cool:

What even are the posts on this topic? Question answered directly by an admin - then we have someone off on a huge tangent and another complaining about political pundits. And now we have someone else complaining about the topic going off the rails?! What has this world come to?
